Welcome to Faria Photography. By booking services, accessing delivered media, or using this website, you agree to the following Terms & Policies. These policies are designed to ensure clarity, protect intellectual property, and maintain compliance with California real estate and MLS standards.

1. Scope of Services

Faria Photography provides real estate media services including, but not limited to:

  • Interior and exterior photography
  • Aerial/drone photography
  • Video walkthroughs
  • Floor plans
  • Virtual tours
  • Property marketing content

Service details for each project are confirmed at the time of booking.

2. Licensing & Usage Rights

All media created by Faria Photography is protected under U.S. Copyright Law.

Clients receive a non‑exclusive, non‑transferable license to use the media solely for marketing the specific property for which it was commissioned.

Clients may not:

  • Reuse media for future listings
  • Transfer or sell media to third parties
  • Use media for personal branding, commercial advertising, or unrelated properties
  • Alter media in a misleading or non‑compliant manner

Extended licensing is available upon request.

3. MLS Compliance Responsibility

Faria Photography does not manage MLS uploads and is not responsible for MLS compliance.

California MLS organizations (including CRMLS, Bay East, CCAR, and bridgeMLS) enforce strict rules regarding:

  • Branding, signage, and personal identifiers
  • Accurate representation of the property
  • Virtual staging disclosures
  • Copyright permissions
  • Prohibited content (people, pets, personal items, license plates)
  • Drone imagery restrictions

Clients are solely responsible for ensuring all uploaded media complies with their MLS rules and California real estate advertising laws.

Faria Photography is not liable for:

  • MLS violations
  • Listing delays
  • Required image removals
  • Fines or penalties

4. Property Access & Preparation

Clients are responsible for:

  • Providing timely access to the property
  • Ensuring the property is photo‑ready
  • Notifying occupants, tenants, or property managers
  • Complying with California privacy laws

If the property is not ready, additional fees may apply for reshoots or wait time.

5. Cancellations & Rescheduling

  • Cancellations within 24 hours of the appointment may incur a fee.
  • Weather‑dependent services (such as drone photography) may be rescheduled at the photographer’s discretion.
  • No‑show appointments may be billed at full rate.

5.1 Reshoot policy

A reshoot may be required when a property or project needs to be photographed again due to factors outside the photographer’s control. This includes, but is not limited to:

  • Property not being ready, staged, or cleaned
  • Access issues or delays
  • Lighting conditions that cannot be changed (shadows, cloud cover, sun position, surrounding trees/structures)
  • Client requests for additional angles, updates, or changes after the original shoot

Standard Reshoot Fee: $150

A reshoot is provided at no additional cost only when the issue is caused by the photographer, such as technical errors, missing required shots that were clearly communicated, equipment malfunction, or rescheduling due to weather.

This policy ensures fairness, protects the photographer’s schedule, and maintains consistent quality for all clients.

6. Delivery Timeline

Standard delivery is typically within 24–48 hours unless otherwise stated.

Rush delivery may be available for an additional fee.

7. Drone & Aerial Media Compliance

Faria Photography operates under FAA Part 107 and complies with all California and local airspace regulations.

Drone flights may be restricted due to:

  • Airspace limitations
  • Weather
  • Safety concerns
  • Local ordinances

The photographer has final authority on whether a flight is legal or safe.

8. Liability Limitations

Faria Photography is not responsible for:

  • Property conditions or staging
  • Personal items visible in photos
  • Injuries occurring on site
  • Unauthorized distribution or misuse of media
  • MLS compliance issues
  • Damages arising from delays due to weather, access issues, or technical failures

Clients agree to indemnify and hold Faria Photography harmless from claims arising from the use of delivered media.

9. Payment Terms

  • Payment is due upon delivery unless otherwise agreed in writing.
  • Late payments may incur additional fees.
  • Travel fees, add‑ons, and reshoot fees will be disclosed prior to booking.

10. Privacy Policy

Faria Photography does not sell or share client information.

Any data collected through this website or booking system is used solely for communication, scheduling, and service delivery.

11. Independent Contractor Status

Faria Photography operates as an independent contractor and is not an employee of any client, brokerage, or real estate organization.

12. Policy Updates

Faria Photography may update these Terms & Policies at any time. Continued use of services constitutes acceptance of the updated terms.
